2. Scope: These Terms and Conditions apply to all purchases of remote coaching services and digital products made through the KIBU Performance website.
3. Acceptance: Any order implies unconditional acceptance of these Terms and Conditions.
4. Services and Products: Services include remote sports coaching, training plans, personalized follow-ups, and the sale of digital products (ebooks, programs, videos, etc.).
5. Pricing and Payment: Prices are displayed in euros, including all taxes. Payment is immediate and secured via Stripe.
6. Right of Withdrawal: In accordance with Article L221-28 of the French Consumer Code, the right of withdrawal does not apply to digital content accessed immediately or to services started with the client's agreement.
7. Access and Execution: Access to services or products is provided within 72 business hours. The obligation is one of means, not results.
8. Cancellation: Monthly subscriptions can be canceled at any time, outside of commitments made, with 7 days' notice before the next billing cycle. No refund is provided for the current month.
9. Client Obligations: The client agrees to provide accurate information, follow recommendations, and obtain a medical certificate if necessary. The client understands that the advice provided does not substitute for professional medical consultation.
10. Non-Medical Substitution Clause: KIBU Performance does not provide medical diagnoses. The advice given does not in any way replace consultation with a healthcare professional.
11. Liability: KIBU Performance cannot be held responsible for injuries or damages resulting from improper application of recommendations or lack of appropriate medical supervision.
12. Intellectual Property: All content provided is protected by copyright. Any reproduction, modification, or distribution without written authorization is prohibited.
13. Personal Data: In accordance with GDPR, data is used solely for service purposes and is never transferred to third parties. The client may request access, rectification, or deletion of their data at [email protected].
14. Access Duration: Access to digital products is guaranteed for 12 months from the date of purchase, unless otherwise specified.
15. Force Majeure: KIBU Performance cannot be held liable in the event of force majeure (pandemic, disaster, major outage, etc.).
16. Applicable Law and Jurisdiction: These Terms and Conditions are governed by French law. Any dispute will be subject to the exclusive jurisdiction of the courts of Caen, France.
17. Mediation: The client may use a consumer mediator free of charge. Mediator contact details available upon request.
18. Applicable Language: These Terms and Conditions are written in English. In case of translation, only the French version shall prevail.
